1. INTRODUCTION AND ACCEPTANCE

1.1 About These Terms

These Terms and Conditions ("Terms") govern your use of:

  • The Heritage Blinman Mine website (www.heritageblinmanmine.com.au)

  • Online booking system

  • Mine tour services

  • Above-ground heritage walk

  • Any other services we provide

1.2 Agreement to Terms

By accessing our website, making a booking, or participating in a tour, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, please do not:

  • Use our website

  • Make a booking

  • Participate in our tours

1.3 Who We Are

Heritage Blinman Mine is a community heritage attraction operated entirely by community members at Mine Road, Blinman, South Australia 5730.

Key Points:

  • We are part of the Blinman Progress Association

  • Our volunteers are passionate community members preserving local heritage

  • Tour fees support mine preservation and community projects

2. BOOKING TERMS

2.1 How to Book

Tours can be booked:

2.2 Booking Confirmation

Your booking is confirmed when:

  • You receive a booking confirmation email

  • Payment has been successfully processed

  • We have not notified you of any issues with your booking

Confirmation Email Contains:

  • Booking reference number

  • Tour date and time

  • Number of guests

  • Total amount paid

  • Meeting point details

  • Important information about your visit

If you don't receive confirmation:

  • Check your spam/junk folder

  • Contact us within 24 hours: (08) 8648 4782

  • Your booking may not be valid without confirmation

2.3 Booking Requirements

You Must:

  • Provide accurate contact information (name, email, phone)

  • Provide accurate number of guests (including children)

  • Be 18 years or older to make a booking (or have parental consent)

  • Read and accept these Terms and Conditions

  • Review our safety requirements before booking

We Reserve the Right to:

  • Refuse bookings without providing reasons

  • Cancel bookings that contain false information

  • Limit the number of bookings per person

  • Contact you to verify booking details

2.4 Booking Modifications

To Change Your Booking:

  • We will accommodate changes where possible, subject to availability

Changes May Include:

  • Date or time of tour

  • Number of guests (additional fees may apply)

  • Special requirements

Please Note:

  • We cannot guarantee availability for changed dates/times

  • Changes within 24 hours of tour may not be possible

  • As a volunteer operation, we appreciate maximum advance notice

2.5 Group Bookings

Groups of 10 or More:

  • Must contact us directly (not via online booking)

  • Require at least 1 month advance notice where possible

  • May be offered private tour options

  • Special rates apply: $33 per adult

 

School Groups:

  • Minimum 1 month advance booking required where possible

  • Age-appropriate content provided

  • Teacher/supervisor responsibilities apply

3. PAYMENT TERMS

3.1 Pricing

Current Prices (as of November 2025):

  • Adult (16+): $40

  • Concession (with valid ID): $33

  • Child (3-15): $20

  • Infant (under 3): FREE

  • Group Rate (20+): $33 per adult

  • Family Rate (2 adults, 2 children) $110 

    • Additional children $15​

Prices Include:

  • Guided underground tour (45-55 minutes)

  • All safety equipment (helmet, torch)

  • Access to above-ground heritage walk

  • Mine office displays and information

3.2 Price Changes

  • Prices are subject to change without notice

  • Price at time of booking applies (not time of tour)

  • We will honour confirmed bookings at the original price

3.3 Payment Methods

We Accept:

  • Credit cards (Visa, Mastercard, American Express)

  • Debit cards

  • Online payment via our secure booking system

We Do Not Accept:

  • Cash payments online

  • Cheques

  • Payment on arrival except where explicitly arranged

3.4 Payment Security

  • All payments are processed securely through our payment provider

  • We do NOT store your credit card details

  • Our payment provider complies with PCI DSS standards

  • Transactions are encrypted using SSL technology

3.5 Payment Confirmation

  • You will receive a payment receipt via email

  • Keep this for your records

  • If payment fails, your booking is not confirmed

  • Contact your bank if payment issues occur

3.6 Currency

All prices are in Australian Dollars (AUD).

 

4. CANCELLATION AND REFUND POLICY

4.1 Customer Cancellations

Cancellations 24+ Hours Before Tour:

  • Full refund provided

  • Contact us by email or phone, or use the cancellation/rescheduling options provided in your online booking confirmation email

  • Refund processed within 5-7 business days

  • Refund to original payment method only

Cancellations Within 24 Hours of Tour:

  • Refunds at our discretion

  • We understand that travel plans can be unpredictable

  • Contact us as soon as possible: (08) 8648 4782

  • We will consider circumstances (weather, vehicle issues, emergencies)

No-Shows:

  • No refund for no-shows without prior contact

  • If you're running late, please call: (08) 8648 4782

  • We may wait up to 15 minutes past tour start time depending on other tours booked that day. You may also be offered the opportunity to reschedule into the next available tour in order to keep other bookings running on time.

4.2 Our Cancellations

We May Cancel Tours Due to:

  • Severe weather conditions

  • Essential maintenance or safety concerns

  • Insufficient bookings

  • Unforeseen circumstances

  • Volunteer availability issues

If We Cancel Your Tour:

  • Full refund provided, OR

  • Option to reschedule to another date at no charge

  • We will notify you as soon as possible (by phone/email)

  • We will refund within 5-7 business days

Extreme Circumstances:

  • Natural disasters, bushfires, floods

  • Government restrictions or closures

  • Public health emergencies

  • Full refund or rescheduling offered

4.3 Partial Cancellations

Reducing Number of Guests:

  • More than 24 hours before: Full refund for cancelled guests

  • Less than 24 hours before: At our discretion

Increasing Number of Guests:

  • Subject to availability

  • Additional payment required before tour

  • Maximum 10 people per tour (strict limit)

4.4 No-Refund Circumstances

No Refund If:

  • You voluntarily leave tour early

  • You are refused entry due to safety concerns (intoxication, inappropriate behaviour)

  • You fail to meet tour requirements (closed-toe shoes)

  • You arrive late and miss the tour

  • You provide false information in your booking

4.5 Refund Processing

  • Refunds processed within 5-7 business days

  • Refunds to original payment method only

  • Bank processing may take additional 3-5 business days

  • Contact us if refund not received within 14 days

​

4.6 Alternative to Refund

Instead of a refund, you may:

  • Receive a credit for future tour

  • Transfer booking to another person (notify us in advance)

  • Reschedule to a different date (subject to availability)

 

5. TOUR PARTICIPATION REQUIREMENTS

5.1 Age Requirements

All Ages Welcome:

  • Tours suitable for all ages

  • Children under 16 must be accompanied by an adult

  • Parents/guardians are responsible for supervising their children

Infants and Young Children:

  • Must wear safety helmets (no exceptions)

  • If uncomfortable with helmets, may not enjoy experience

  • Parent may be asked to step out if child becomes distressed

  • Strollers not permitted underground

5.2 Mandatory Safety Equipment

All Participants Must Wear:

  • Safety helmet (provided) - no exceptions

  • Closed-toe shoes - mandatory

Not Permitted:

  • Sandals, thongs (flip-flops), open-toe shoes

  • High heels or dress shoes

  • Bare feet

If You Arrive Without Proper Footwear:

  • You will not be permitted on the tour

  • No refund will be provided

5.3 Physical Requirements

Tour Involves:

  • Walking for 45-55 minutes on uneven surfaces

  • Standing while listening to guide

  • Navigating one moderate slope (1:6 gradient)

  • Ducking in some areas if over 180cm (5'11") tall

  • No stairs or crawling required

You Should Have:

  • Average mobility

  • Ability to walk for extended periods

  • Balance and stability on uneven ground

Not Suitable For:

  • Wheelchairs or mobility scooters (underground)

  • Severe mobility limitations

  • Recent surgeries affecting mobility

5.4 Health and Medical Conditions

You Must Inform Us If You Have:

  • Severe claustrophobia

  • Heart conditions

  • Respiratory conditions

  • Epilepsy or seizure disorders

  • Recent injuries

  • Pregnancy (especially advanced)

  • Any condition that may affect tour participation

We May:

  • Provide modified tour experience

  • Recommend alternative activities

  • Refuse participation if safety risk identified

You Are Responsible For:

  • Assessing your own fitness for the tour

  • Bringing necessary medications

  • Informing guide of any concerns during tour

5.5 Claustrophobia

Important Information:

  • Tunnels are well-lit and ventilated

  • No locked doors or enclosed spaces

  • No crawling required

  • Guides can escort you out anytime

  • Many people with mild claustrophobia complete tour successfully

If You Experience Distress:

  • Inform your guide immediately

  • Guide will escort you to surface

  • No refund for early exit

  • Above-ground heritage walk available as alternative

5.6 Accessibility

Underground Tour:

  • NOT wheelchair accessible

  • NOT suitable for mobility scooters

  • Uneven surfaces and slope

Above-Ground Heritage Walk:

  • NOT Wheelchair accessible

  • NOT Mobility scooter accessible

  • Alternative for those unable to go underground

6. SAFETY RULES AND CONDUCT

6.1 Mandatory Safety Rules

You Must:

  • Follow all guide instructions at all times

  • Wear provided safety helmet throughout tour

  • Stay with your group and guide

  • Not wander off or explore independently

  • Watch your step on uneven surfaces

  • Use handrails where provided

  • Keep children supervised and within reach

You Must Not:

  • Touch or remove any artefacts or equipment

  • Smoke anywhere on mine property

  • Consume alcohol or drugs before or during tour

  • Enter restricted or unmarked areas

  • Bring large bags or backpacks underground

6.2 Prohibited Behaviour

The Following Are Strictly Prohibited:

  • Intoxication or drug use

  • Dangerous, reckless, or aggressive behavior

  • Harassment of staff, guides, or other visitors

  • Vandalism or damage to property

  • Theft of artifacts or equipment

  • Ignoring safety instructions

  • Disturbing other tour participants

Consequences:

  • Immediate removal from tour

  • No refund

  • Possible ban from future visits

  • Police involvement if necessary

6.3 Supervision of Children

Parents/Guardians Must:

  • Supervise children at all times

  • Ensure children follow safety rules

  • Keep children within arm's reach underground

  • Prevent children from running or climbing

  • Remove distressed children promptly

We May:

  • Ask parents to remove disruptive children

  • End tour early if safety compromised

  • No refund if removed for behavioural issues

6.4 Guide Authority

Tour Guides Have Authority To:

  • Stop the tour if safety concerns arise

  • Remove participants who pose safety risks

  • Modify tour route if necessary

  • Refuse entry to anyone not meeting requirements

  • End tour early in emergency situations

Guide Decisions Are Final:

  • No refunds for removal due to safety

  • No arguments or disputes during tour

  • Complaints can be lodged after tour

 

7. LIABILITY AND RISK

7.1 Acknowledgment of Risk

By Participating, You Acknowledge:

  • Mine tours involve inherent risks

  • Walking on uneven surfaces carries risk of trips or falls

  • Underground environment has unique hazards

  • Despite safety measures, injuries can occur

  • You participate at your own risk

7.2 Our Responsibility

We Are Responsible For:

  • Maintaining mine in safe condition

  • Providing appropriate safety equipment

  • Training volunteer guides in safety procedures

  • Conducting regular safety inspections

  • Warning of known hazards

  • Following industry safety standards

We Will:

  • Take reasonable care for your safety

  • Maintain appropriate insurance

  • Respond to emergencies appropriately

  • Investigate incidents thoroughly

7.3 Limitation of Liability

To the Extent Permitted by Law:

We are NOT liable for:

  • Personal injury or death arising from your own negligence

  • Loss or damage to personal property

  • Injuries resulting from ignoring safety instructions

  • Pre-existing medical conditions

  • Injuries occurring outside mine premises

  • Acts of nature or circumstances beyond our control

Maximum Liability:

  • Limited to the amount you paid for your tour

  • Except where prohibited by Australian Consumer Law

7.4 Australian Consumer Law

Nothing in These Terms Excludes:

  • Statutory guarantees under Australian Consumer Law

  • Rights that cannot be excluded by law

  • Our liability for negligence causing death or personal injury

You Have Rights:

  • Services must be provided with due care and skill

  • Services must be fit for purpose

  • These rights cannot be excluded

7.5 Volunteer-Operated Disclaimer

Important Notice:

  • Heritage Blinman Mine is operated at times by volunteers

  • Volunteers are not professional tour operators

  • Volunteers have undergone safety training

  • We maintain appropriate insurance coverage

  • Professional standards apply despite volunteer status

7.6 Insurance

Our Insurance:

  • We maintain public liability insurance

  • Coverage details available upon request

Your Insurance:

  • We recommend you have travel insurance

  • Check your policy covers adventure/heritage activities

  • We are not responsible for your insurance coverage

7.7 Indemnity

You Agree to Indemnify Us Against:

  • Claims arising from your breach of these Terms

  • Claims arising from your negligence or misconduct

  • Legal costs incurred defending such claims

  • Damage you cause to property or equipment

 

8. PHOTOGRAPHY AND MEDIA

8.1 Your Photography

You May:

  • Take photos and videos for personal use

  • Share photos on social media

  • Tag us: @heritageblinmanmine

You Must Not:

  • Use photos for commercial purposes without permission

  • Sell or license photos without written consent

  • Edit photos in misleading ways

  • Use flash photography where prohibited

8.2 Our Photography

We May:

  • Take photos or videos during tours

  • Use images for promotional purposes (website, social media, brochures)

  • Feature images in media releases or publications

By Participating:

  • You consent to potentially appearing in our promotional materials

  • You grant us a non-exclusive, royalty-free license to use images

Opting Out:

  • Inform your guide at start of tour

  • We will make reasonable efforts to exclude you from photos

  • We cannot control photos taken by other participants

8.3 Other Participants' Photos

We Cannot Control:

  • Photos taken by other tour participants

  • How other participants use their photos

  • Removal of images shared by others

If You Have Concerns:

  • Address them directly with the person taking photos

  • We can request others respect your wishes

  • We cannot enforce removal of others' photos

8.4 Media and Film Crews

9. INTELLECTUAL PROPERTY

9.1 Our Content

We Own or Have Rights To:

  • Website content and design

  • Logo and branding

  • Tour scripts and presentations

  • Sound and light installations

  • Historic photos and displays

  • Educational materials

  • Promotional materials

9.2 Your Use of Our Content

You May:

  • View our website for personal use

  • Print single copies for personal reference

  • Share our web pages via social media

You Must Not:

  • Copy or reproduce our content without permission

  • Use our branding or logo without written consent

  • Remove copyright or attribution notices

If You Submit Content to Us:

  • Reviews, photos, testimonials, comments

  • Alternative booking methods available (phone, email)

We Strive For Accuracy But:

  • Information may occasionally be outdated

  • Technical errors may occur

  • Prices and availability subject to change

  • We are not liable for errors or omissions

11. FORCE MAJEURE

11.1 Events Beyond Our Control

We Are Not Liable For Failure to Perform Due To:

  • Natural disasters (bushfires, floods, earthquakes)

  • Extreme weather conditions

  • Government restrictions or orders

  • Public health emergencies or pandemics

  • Civil unrest or terrorism

  • Power outages or infrastructure failures

  • Acts of God

11.2 Our Response

If Force Majeure Occurs:

  • Tours may be cancelled or postponed

  • We will notify you as soon as possible

  • Full refund or rescheduling offered

  • No additional compensation provided

 

12. GENERAL PROVISIONS

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Heritage Blinman Mine.

12.2 Severability

If any provision is found invalid or unenforceable:

  • That provision will be limited or eliminated to minimum extent

  • Remaining provisions remain in full effect

12.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

12.4 Assignment

You Cannot:

  • Transfer your booking without our permission

  • Assign rights or obligations under these Terms

We May:

  • Assign or transfer our rights and obligations

  • Transfer operations to another entity

12.5 Relationship

Nothing in these Terms creates:

  • Partnership or joint venture

  • Employment relationship

  • Agency relationship

  • Fiduciary duty

You are an independent customer purchasing tour services.

12.6 Third-Party Rights

These Terms are between you and Heritage Blinman Mine only. Third parties have no rights to enforce these Terms.

  • Friendly resolution

13. CHANGES TO TERMS

We may update these Terms:

  • Based on feedback or issues

  • Cancel existing bookings (full refund if more than 24 hours away)

  • Don't make future bookings

14. SPECIAL CONDITIONS

14.1 Seasonal Operations

April - October (Peak Season):

  • Regular daily tours: 10am, 12pm, 2pm

  • Full volunteer availability

  • Advance booking recommended

November - March (Summer/Off-Peak):

  • Tours by appointment only

  • Reduced volunteer availability

  • Essential maintenance may occur

  • Advance contact required

  • Potential closures - check before traveling

14.2 Weather Conditions

Tours Run In:

  • Light rain (mine is underground!)

  • Cold weather (mine is constant 22°C)

  • Mild wind

Tours May Cancel For:

  • Severe storms (lightning risk)

  • Extreme heat (40°C+ above ground safety)

  • Flooding affecting access

  • Bushfire risk

14.3 Road Conditions

Important:

  • Blinman is remote (485km from Adelaide)

  • Unsealed roads in surrounding areas

  • Weather can affect road access

  • Check road conditions before traveling: https://traffic.sa.gov.au

We Are Not Responsible For:

  • Your travel to/from Blinman

  • Road closures or delays

  • Vehicle breakdowns

  • Travel expenses if tour cancelled

14.4 No Fuel in Blinman

Critical Information:

  • No fuel available in Blinman township

  • Nearest fuel: Angorichina Tourist Village (9km), Hawker (95km), Wilpena Pound (60km)

  • Fill up before arrival

  • We are not liable if you run out of fuel

 

15. ACKNOWLEDGMENTS

15.1 Traditional Owners

Heritage Blinman Mine acknowledges the Adnyamathanha people as the traditional custodians of the land on which we operate. We pay respect to Elders past, present, and emerging.

15.2 Volunteer Community

You Acknowledge:

  • We are at times volunteer-operated

  • Volunteers donate their time to preserve heritage

  • Your booking supports community heritage preservation

  • Response times may vary due to volunteer and staff availability

15.3 Community Support

Your Tour Fee Supports:

  • Mine preservation and maintenance

  • Safety equipment and upgrades

  • Community projects in Blinman

  • Heritage education programs

  • Keeping history alive for future generations
